1. INTRODUCTION

 

1.1 These King Warranty Terms are limited in their application to products which are purchased for personal, household or domestic use. If you purchase a product for a commercial purpose, (not for personal, household or domestic use), then these King Warranty Terms do not apply.

1.2 King provides a standard limited warranty to you as the original purchaser of all King-branded products and selected components of those products (collectively, Products), as specified in this warranty document (Warranty). This Warranty covers repair or replacement (at King Living’s sole discretion) of Products against failure due to manufacturing defect during the period listed in the table below (each a Warranty Period), subject to the further terms in this Warranty.

1.3 Each Warranty Period begins running from the date of delivery of the Product.

1.4 Service visits are included in the Warranty, subject to the following limitations:

(a) If the Product is delivered within a metropolitan area having a King showroom (Metro Area), King will make arrangements with you to make a service visit at a mutually convenient time to assess the Warrantied Product and/or collect that Product at no cost to you; and

(b) If the Product is located outside of a Metro Area, then you must make arrangements with King to return the Product to a King warehouse as selected by King and at your sole cost so as to enable King’s service technician to assess the Warrantied Product.

1.5 King reserves the right to change these Warranty Terms at any time. Any such change will apply to purchases of Products after such change comes into effect. For avoidance of doubt, King will continue to honor the terms of any applicable Warranty in effect at the time you purchased a Product.


2. WARRANTY COVERAGE AND PERIOD

 

2.1 Each Warranty period listed in the table below is specific to the referenced Product type. Please note the exclusions listed below (under the heading “What is not covered by the Warranty?”), as well as the specific exclusions for each specific Product in the table.

3. OPTIONAL THREE (3) YEAR WARRANTY EXTENSION

 

3.1 The 2-year Warranty Period for electronics and motion components specified in item 13 of the table may be extended if you are an eligible customer for an additional 3 years (thereby totalling 5 years) (3 Year Extended Warranty). This 3 Year Extended Warranty comes at an additional charge per module, payable by to King at the time you purchase the Product. In addition to all other terms and conditions of this Warranty, the 3 Year Extended Warranty is subject to the following conditions:

(a) your delivery address must be within a Metro Area (an Eligible Customer Address); and

(b) Products must remain at the Eligible Customer Address for the duration of the 2-year standard Warranty Period and the subsequent 3 Year Extended Warranty period.

3.2 Please check with King staff upon purchase of your Product to confirm whether your address is an Eligible Customer Address for the Extended Warranty.

 

4. WHAT IS NOT COVERED BY THE WARRANTY?

 

4.1 Coverage under this Warranty does not apply:

(a) If you purchase a product for a commercial purpose, (not for personal, household or domestic use);

(b) To any exclusions specifically listed for the relevant Product in the above table;

(c) If the Product has been delivered to a locality outside of the USA whether by King, another third party, or you (and noting the limitations imposed by subparagraph 4);

(d) If, at any stage during you use of the Product, you transport the Product outside of the USA;

(e) Where the Product has:

i. not been purchased directly from King; and

ii. had any product tags removed, altered or defaced; or

iii. been modified or changed without approval from King;

(f) To fabrics supplied by you or outside suppliers. Fabrics and leathers supplied by an outside supplier may be covered by the supplier’s own warranties;

(g) To normal wear and tear associated with the Products. Fabrics, leathers, rugs, suspension components, cushioning and fillings will show signs of wear and tear with use. Fabrics, rugs and leathers will fade and crease. Foam and fillings will soften and form to the shape of the user over time. Depending on the covering and the degree of use, the covering materials, cushion fillings and suspension may need to be replaced periodically at the purchaser’s expense. Scars, marks and differing pore density and color are natural characteristics of leather and are not to be considered defects. King reserves the right to determine at its discretion whether a Product component has failed due to either a defect or due to wear and tear. Any item requiring replacement due to wear and tear will be at your own expense;

(h) To color variations caused by exposure to the local environment for products including but not limited to fabrics, leathers, rugs, timber veneer and solid timber;

(i) To damage caused by use of parts and consumables that are not the genuine manufacturer’s parts and consumables;

(j) To freight, call-out fees, labor and other items associated with making a claim under this Warranty where the claim is an invalid warranty claim. If the claim is a valid warranty claim, then King will be liable only for the costs that it has pre-approved in writing, which you must obtained prior to your incurring any such costs. All costs for which pre-approval in writing is not obtained by you in accordance with this subparagraph are excluded from this Warranty and they will be charged to you at standard King rates; and

(k) To Products that become defective as a consequence of misuse, lack of proper care and maintenance, commercial use or handling in transit. You must use and maintain the Products in accordance with the care instructions for the relevant Product as provided on King’s website and any other information made available you by King. If a Product becomes defective, you must not attempt to repair it yourself. Doing so may cause damage not covered by this Warranty, or otherwise affect your rights under this Warranty.

4.2 This Warranty only applies to you as the original purchaser of the Products where the Products are delivered to a U.S. delivery address and remain in the U.S. for the life of the product. You may not assign or transfer any benefit conferred by this Warranty, and any purported transfer is void. All subsequent purchasers shall acquire the Products “as is” without any protection of the Warranty, regardless of any term remaining in the table above.

 

5. HOW DO YOU LODGE A WARRANTY CLAIM?

 

5.1 You must notify King Customer Service within 14 days of any defect occurring, by either:

(a) calling the telephone number +1 833 546 4548; or

(b) by email to service@kingliving.com

5.2 You must provide the following information upon notification of the defect:

  • Your name; and

  • Order delivery address; and

  • Your phone number; and

  • King Living product details; and

  • Details of the defect claimed

 5.3 Once notification of a Warranty claim is received by King, a representative of King Customer Service will help determine whether your Warranty claim is valid, and if it is, will inform you how King will honor it. You may be required to provide King with:

  • Photographic evidence of the defect;

  • A written explanation of the defect;

  • Details of the defect over the phone with King Customer Service.


5.4 During the process, King Customer Service may, before providing Warranty service, require that you respond to questions designed to assist with diagnosing potential faults and follow their procedures for obtaining the Warranty. You must respond to all requests promptly. King reserves the right in its absolute discretion to determine whether any part of a Product has failed due to a defect, or instead due to wear and tear.

 

6. HOW WILL A VALID WARRANTY CLAIM BE HONORED?

 

6.1 All Warranty claims determined by King Customer Service to be valid will be honored. If you receive a refund or a replacement Product or component from King Customer Service, the replacement Product or component becomes your property and the replaced Product or component becomes King’s property.

6.2 To honor a Warranty claim relating to a Product, King will, at its option:

(a) Replace the Product or supply an equivalent product.; or

(b) Repair the product; or

(c) Pay the cost of replacing the Product by acquiring an equivalent product for you.; or

(d) Pay the reasonable cost of your having the product repaired by a third party.

6.3 To honor a Warranty claim under a Warranty that relates to a recliner electronics and motion component, King will, at its option:

(a) Replace the recliner electronics or motion component or supply equivalent recliner electronics or motion component.; or

(b) Repair the recliner electronics or motion component; or

(c) Pay the cost of replacing the recliner electronics or motion component or acquiring an equivalent recliner electronics or motion component.; or

(d) Pay the cost of having the recliner electronics or motion component repaired.


6.4 Components replaced under this Warranty may vary in color and texture to the original and such variations are not considered a defect.

6.5 Any repair or replacement under this Warranty is limited to the defective component only.

 

7. DISCLAIMER

 

7.1 Solely to the extent permitted by applicable law, all other warranties implied or otherwise not set out in this Warranty are excluded. King will be under no liability in contract, tort (including without limitation, negligence), or breach of statutory duty to otherwise compensate the party eligible to make a warranty claim for:

(a) any expenses incurred by the purchaser or a third party;

(b) any loss of profit, revenue, business, contracts or anticipated savings;

(c) any loss or expense resulting from a claim by a third party;

(d) any special, indirect or consequential losses or damages caused by King’s failure to complete or delay in completing any of its obligations under this Warranty.

 

8. LIMITATIONS ON DISCLAIMER

 

8.1 This limited Warranty is not a full warranty and further is subject to the conditions set forth by the Magnuson-Moss Warranty Act (15 U.S.C. § 2301 et seq.). To the extent permissible by law, all implied warranties are limited in duration to the Warranty Period set forth herein. For sales of Products within California, the provisions of the Warranty coverage are aligned with the California Song-Beverly Consumer Warranty Act (Cal. Civ. Code § 1790 et seq.), ensuring that the Warranty period commences upon the delivery of the Products to you.

8.2 The benefits given to you by this Warranty are additional to other rights and remedies that you may have in relation to our products. Any paragraph or term of this Warranty which is unenforceable or void is to be severed and the rest of this Warranty will remain in force.

Sleep+® 30 Day Mattress Warranty

(also known as the Sleep Plus® 30 Day Mattress Warranty)

 

1. INTRODUCTION

 

1.1 This Sleep+ 30 Day Mattress Warranty (30 Day Mattress Warranty) is limited in its application to products which are purchased for personal, household or domestic use. If you purchase a product for a commercial purpose, (not for personal, household or domestic use), then this 30 Day Mattress Warranty does not apply.


1.2 This Sleep+ 30 Day Mattress Warranty (30 Day Mattress Warranty) is provided in addition and subject to the terms of the standard limited Warranty above and applies for Products specified in the table at item 14 (“Sleep+ products (excluding Fit Cover)”) and item 15 (“Fit Cover”). The 30 Day Mattress Warranty is provided to you if you are an eligible customer who directly purchases such a Product from King Living (“Mattress”). This 30 Day Mattress Warranty is subject to all of the conditions expressed below.


1.3 Within 30 days after the delivery date of the Sleep+ mattress (Mattress), you may request return of a mattress for the reasons stated below, and King will (subject to the other terms of this 30 Day Mattress Warranty), collect the Mattress from your address and provide you with a full refund of the purchase price you paid for the Mattress. All of the following criteria must be satisfied:

(a) you keep the mattress for at least 14 days from the delivery date;

(b) after such period, you notify King in writing that you are not satisfied with the mattress due solely to your comfort while using the mattress, and not for any aesthetic reasons or change in your preference of size, color, pricing, or features;

(c) after notifying King as specified above, you make any and all modifications or adjustments to the Mattress that are suggested by King in response to your notification;

(d) you have not previously purchased and claimed on the 30 Day Mattress Warranty in relation to any other Mattress at any time;

(e) you have paid to King the full purchase price for the Mattress;

(f) you have used the Mattress only in your home, and not at any time any for commercial purposes (including without limitation in a hotel, motel, hostel or other paid lodging or accommodation services, and further including use in any building or facility pursuant to a peer-to-peer accommodation marketplace such as Airbnb); and

(g) the Mattress is not damaged or stained (except as covered under the limited Warranty Terms above.

 

1.4 You must use and maintain the Mattress in accordance with the care instructions for the relevant Mattress as provided on King’s website and any other information made available you by King. If a component of a Mattress becomes defective, you must not attempt to repair it yourself.

1.5 When King has determined that all of the criteria in subparagraph 1.3 have been satisfied:

(a) If your delivery address is within a Metro Area, King will make arrangements with you to collect your Mattress from your delivery address at King’s cost (generally, on the next available delivery timeslot for collection of the item); and

(b) if your delivery address is outside of any Metro Area, you must make arrangements with King to return the Mattress to a King warehouse as selected by King at your sole cost.

 

1.6 King will refund the purchase price of the Sleep+ mattress to you within 10 business days after the Sleep+ mattress is received at King’s warehouse. The purchase price will be refunded to the credit card, debit card or bank account you used for your initial purchase of the Mattress.

1.7 If King reasonably determines after inspection of the Mattress that the Mattress has been damaged by you or has been used in such a way that your claim does not satisfy the conditions of this 30 Day Mattress Warranty (an Invalid Warranty Claim) then:

(a) the purchase price of the Mattress will not be refunded; and

i. King will return the Mattress to your address at your sole cost; or

ii. you must collect the Mattress within 7 days from King’s, and if you do not collect the Mattress within 7 days, King has the right to dispose of the Mattress without refunding the purchase price or any further notice to you; and

(b) costs incurred by you for freight, call-out fees, labor and other items associated with making a claim under this 30 Day Mattress Warranty will not be refunded. Those costs (if incurred by King) will be charged to you at King’s standard rates.

1.8 If a valid claim is approved by King (and a refund is paid to you), King will also reimburse any ancillary costs that King has pre-approved in writing prior to your incurring those costs. Ancillary costs which have not been pre-approved in writing by King are excluded from reimbursement under this 30 Day Mattress Warranty.
